Terms of Service

When engaging with MayneWeb's products or services, you automatically accept the current Terms of Service (“Terms”). Breach of these terms may lead to the termination of your account at our discretion.

MayneWeb reserves the right to modify these Terms of Service at any given time. In the event of substantial alterations, we will update the date at the outset of this page and inform individuals subscribed to our policy updates mailing list.

Definitions

"MayneWeb", "company", "we", "our", or "us" in any of our policies or terms, refers to Daveyon Mayne.

The term "Services" encompasses our online platforms, such as those found at mayneweb.com, as well as any product developed and managed by MayneWeb. This encompasses ektarOS (FarmSwop) (in all its iterations), Clipity, and any software produced or made by MayneWeb, whether accessed through a web browser, desktop application, mobile application, or any other medium.

Lastly, the terms "you" or "your" pertain to individuals or entities possessing an account with one or more of our Services.

Account Terms

  • It is your responsibility to uphold the security of your account and password, as well as to ensure that any users under your account do likewise. The Company bears no liability for any loss or damage resulting from your failure to fulfill this security obligation.
  • Usage of the Services for any purpose outlined in our Use Restrictions Policy is prohibited, and you are not permitted to authorize any of your users to do so either.
  • All content posted to and activities occurring under your account, including those initiated by any users within your account, are your responsibility.
  • Only human users are permitted. Registration of accounts by "bots" or any other automated methods is prohibited.

Cancellation and Termination

  • It is your sole responsibility to ensure the proper cancellation of your account. Instructions for canceling your account can be found in our Cancellation Policy. Please note that an email or phone request alone does not automatically constitute cancellation. Should you require assistance with canceling your account, feel free to reach out to our Support team for help.
  • Upon cancellation of your account, all your content will become inaccessible on the Services immediately. Within 30 days, all content will be permanently removed from active systems and logs. Within 60 days, all content will be permanently erased from our backups. Once this information has been permanently deleted, it cannot be recovered.
  • Should you decide to cancel the Service before the conclusion of your current paid-up month, your cancellation will be promptly enacted, and no further charges will be applied. Please note that unused time in the last billing cycle will not be automatically prorated. For further details, refer to our Refund Policy.
  • We retain the right to suspend or terminate your account and decline any present or future utilization of our Services at our discretion, regardless of the reason and timing. Suspension entails the restriction of access to the account and its contents for you and any other users associated with your account. Termination, on the other hand, involves the deletion of your account, your access to it, and all content contained within. Additionally, we reserve the authority to deny Service usage to anyone, for any reason, at any time, including, but not limited to, breaches of our Use Restrictions Policy.
  • Any form of abuse, whether verbal, physical, written, or otherwise, directed towards a Company employee or officer, including threats of abuse or retribution, will lead to immediate termination of your account.

Liability

By using the Services, you acknowledge that the Company bears no liability to you or any third party for damages of any nature arising from such use, including but not limited to the inability to access data or unauthorized access to your data or account. Furthermore, the Company shall not be held responsible for damages of any sort resulting from actions taken by any third party utilizing the Services, or any other repercussions related to the Terms or Services.
